Prenuptial/ Postnuptial Agreement
In addition to divorce, we offer services of prenuptial/postnuptial agreements. In the New York State, in the absence of a matrimonial agreement, property acquired or owned by the spouses during the marriage will be subject to equitable distribution. A prenuptial/postnuptial agreement is a contract clarifying what you and your spouse would like to handle real properties and assets during the marriage y, potentially, in case of divorce or death.
Specifically, such agreements define:
- separate property, real property and assets that you and your spouse bring during the marriage;
- matrimonial properties: real properties and assets that you and your spouse acquired during the marriage, properties subject to equitable distribution in case of divorce, increased earning/valorization of the properties during the marriage;
- property acquired by inheritance or gifts;
- spousal support;
- alimony; and
- pre-marriage debts.
