Disability Discrimination
Disparate treatment on the basis of disability is prohibited by the American Disabilities Act (ADA), which prohibits employers from basing employment decisions on the fact that you have a disability if you are qualified for the job.
Disability discrimination can take many forms, including:
- refusing to accommodate a disability, if such accommodation is not overly burdensome for the employer;
- refusing to hire a job candidate due to the disability, if the candidate is qualified and able to do the job;
- firing an employee due to the disability, if the candidate is qualified and able to do the job;
- considering the employee’s disability in deciding pay, job assignments, promotions, layoffs, training, and other decisions that affect any other conditions of employment;
- abusive/ hostile working conditions created by severe or frequent comments about the disaiblity.
