TROY LAW: Consumer Protection

Consumer Protection

CONSUMER Food & Cosmetics Product Liability False Advertising

American consumers have the legal right to have truthful information presented to them about products and services that they wish to purchase. State and federal laws protect consumers against fraud and scams in advertisements and any false, misleading or deceptive claims from businesses about the quality, price or purpose of any product or services.

This includes false or misleading advertising or representation on food, cosmetics, and other products. This may include such practices like the substitute of one product for another, a misrepresentation of the types or nature of ingredients or constituent included in the product; and the failure to ensure that the food is safe to eat or cosmetic safe to apply.

Some companies also illegally and surreptitiously collect and sell your personal data, resulting in a loss of privacy which occurs without your permission.

Other companies use bait and switch tactics and advertise their products or services at a certain price, before switching into an inflated higher price. Companies also may include a surcharge or do not truthfully represent the length of their subscription services, resulting in charges for non-existing services, and/or a hefty cancellation fee or renewal fee because of non-notification of cancellation.

Consumer class actions, or actions brought by an individual consumer or a small group of consumers on behalf of a broader class of similarly situated consumers, is critical to challenging all of the above practices. As a vehicle, it allows consumers who individually have suffered a negligible claim to potentially change false, misleading or deceptive claims from the businesses.
